The term "Registered Visitor" will from here on refer to any and all users of EcoSee who have chosen to register their user information with EcoSee or signup and use our services. The term "Photographer" refers to subscribers who intend or are actively selling photographs or products via EcoSee. The term "Purchaser" refers to any visitor of EcoSee purchasing photographs or products via EcoSee. The term "Billing Period" will from here on refer to time period identified in your subscription plan as billing period.
EcoSee is an online subscription based service where avid photographers can generate their own websites and exhibit, organize, print and sell their photographs. By using this Website You agree to abide by all the terms and Conditions of this agreement. By creating your own website through the use of our service, you agree that you are your own entity and own your own website where you are bound by laws of your town, city, state, country, and or region.
EcoSee reserves the right to modify or add additional Conditions to this agreement, including but not limited to changes in billing terms, privacy policy, new functionality and access restrictions. Reasonable prior notice will be provided for changes to billing terms, termination of Services, mergers, and acquisitions. All communication with users and all notices will be sent electronically. It is Your responsibility to maintain a valid email account and to update EcoSee with your current email information. It is Your responsibility to regularly check the email account provided to EcoSee or this Website in order to be aware of any communications or notices. You hereby specifically agree that a notice sent to Your email account or posted on this Website constitutes sufficient notice. EcoSee may change the Services it offers or Condition of use at any time. EcoSee will renew your subscription automatically at the end of each billing period. All materials transmitted to EcoSee will be stored in the United States. All images posted to your own EcoSee powered website becomes your own legal responsibility.
Subject to the Conditions set forth in this agreement, EcoSee agrees to host Photographer's websites, and is not responsible for the content or legal ramifications of said content. Photographers will have the ability to present and sell photos to Purchasers via their EcoSee powered websites and are solely responsible for those images and orders. EcoSee will not directly offer Services such as order fulfillment, shipping and handling. The owner's of EcoSee powered sites are directly responsible for their sites, images, and any orders generated via their sites.
EcoSee is not in anyway responsible for order fulfillment on EcoSee powered web sites. Owners of said sites are solely responsible for any images they sell and the legality of said images. EcoSee is responsible for providing the hosting service for EcoSee powered sites and will make every attempt to keep the servers running and the sites available to the web. From time to time EcoSee powered sites may experience server downtime, and You agree that EcoSee is in no way responsible for the loss of any sales during these unplanned downtimes. Every attempt will be made by EcoSee to avoid any server downtime. You will not be entitled to any financial refunds in part or in full for server downtime for any reason. You are responsible for keeping a backup of your images and any loss of said images on our servers is not the responsibility of EcoSee.
EcoSee will charge site owners annually for the continued use of our services. In the event that an owner's account becomes delinquent and EcoSee is not able to collect amounts owed, EcoSee reserves the right to discontinue services. EcoSee reserves the right to terminate delinquent accounts at EcoSee's discretion. Nothing in the Conditions shall limit EcoSee's right to pursue all remedies allowed by law to collect on delinquent accounts.

EcoSee agrees to terminate Your account within 30 days of receiving a notice from You. EcoSee will not refund the remainder of the fee for the current Billing Period.

Photographer or Affilaitesshall be solely responsible for, and will file, as required by law, all tax returns and payments required to be filed with, or made to, any federal, state or local tax authority with respect to the performance of services and receipt of fees under the Conditions of this agreement. Photographer or Affilaites shall be solely liable for any failure to pay applicable taxes. EcoSee will not withhold any part of Photographers' or Affilaites' compensation for the payment of any social security, federal, state or any other employee payroll taxes. EcoSee will report amounts paid to Photographers or Affiliates by filing appropriate forms with the Internal Revenue Service as required by law.
Those users of EcoSee who reside or do business outside of the United States of America specifically agree to comply with all the local laws, rules, and regulations regarding the use of this Website, including but not limited to, the transmission of data over the Internet, and applicable tax laws.
These terms and Conditions are entered into in the State of California and shall be governed by and construed in accordance with the laws of the State of California, exclusive of its choice of law rules.
